Validity of the sales contract, product and price information

The terms of sale apply when purchasing goods from the Online Store.

The prices of the products sold in the Online Store are indicated next to the products. VAT and the delivery fee are added to the price.

The delivery fee depends on the buyer’s location and the delivery method. The delivery fee is displayed to the buyer when placing the order.

Information about the goods is presented in the Online Store directly next to the goods.

Placing an order

To order goods, add the desired products to the shopping cart. To place the order, fill in the required data fields and choose a suitable delivery method for the products. Then the amount payable will be displayed on the screen, which can be paid via a bank link or another payment solution.

The contract enters into force upon receipt of the amount payable in the Online Store’s bank account.

If it is not possible to deliver the ordered goods due to the goods being out of stock or for another reason, the buyer will be informed at the first opportunity and the paid money (including delivery costs) will generally be refunded within 1–2 working days. Depending on the payment method, receipt may take up to 7 working days.

Delivery

Goods are shipped to the following countries: Estonia, Finland.

The delivery costs are borne by the buyer and the corresponding price information is displayed next to the delivery method.

Shipments within Estonia generally reach the destination specified by the buyer within 3–7 working days from the entry into force of the sales contract. Delivery outside Estonia takes place within 10 calendar days.

In exceptional cases, the right exists to deliver the goods within up to 30 calendar days.

Right of withdrawal

After receiving the order, the buyer has the right to withdraw from the contract concluded in the online store within 14 days, except in cases corresponding to the conditions listed in § 53(4) of the Law of Obligations Act. (E.g. upon delivery of an item made according to conditions provided by the consumer.)
The right of withdrawal does not apply if the buyer is a legal entity.

To exercise the 14-day right of return, the ordered goods must not be used in any way other than what is necessary to ascertain the nature, characteristics and functioning of the goods in the same way as permitted for testing goods in a physical store.

If the goods have been used for purposes other than what is necessary to ascertain the nature, characteristics and functioning of the goods or if there are signs of use or wear, the Online Store has the right to reduce the refundable amount according to the decrease in the value of the goods.

To return the goods, a withdrawal statement must be submitted  and sent to the email address no later than 14 days from receiving the goods.

The costs of returning the goods are borne by the buyer, except where the reason for return is that the item to be returned does not correspond to what was ordered (e.g. wrong or defective item).

The buyer must return the goods within 14 days following the submission of the statement or provide proof that they have handed the goods over to the carrier within the aforementioned period.

Upon receipt of the returned goods, the Online Store refunds to the buyer without delay, but no later than 14 days after receiving the withdrawal statement, all payments received from the buyer under the contract.

The Online Store may refuse to make refunds until it has received the item that is the subject of the contract back or until the buyer has provided evidence that the item has been sent back, depending on which occurs first.

If the buyer has expressly chosen a delivery method different from the cheapest standard delivery method offered by the Online Store, the Online Store does not have to refund the consumer the cost that exceeds the cost associated with the standard delivery method.

The Online Store has the right to withdraw from the sales transaction and demand the goods back from the buyer if the price of the goods in the online store has been mistakenly indicated significantly below the market price of the goods.

Right to submit a claim

The Online Store is liable for non-conformity with the contract terms or a defect of the goods sold to the buyer that existed already at the time of delivery and that becomes apparent within up to two years from delivery of the goods to the buyer. During the first year from delivery to the buyer it is presumed that the defect existed already at the time of delivery. Rebutting this presumption is the obligation of the Online Store.

If a defect appears, the buyer has the right to contact the online store no later than within two months by sending an email to myyk@pixmill.ee or calling: (+372) 5855 9826.

The Online Store is not liable for defects that have arisen after delivery of the goods due to the consumer’s actions or omissions (incorrect use, accident, etc.) or if it is due to normal wear and tear resulting from normal use of the item.

If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If it is not possible to repair or replace the goods, the Online Store will refund to the buyer all fees associated with the sales contract.

The Online Store responds to the consumer’s complaint in writing or in a format that can be reproduced in writing within 15 days.

Dispute resolution

If the buyer has complaints regarding the Online Store, they must first be sent to the email address myyk@pixmill.ee or call: (+372) 5855 9826.

If the buyer and the Online Store are unable to resolve the dispute by agreement, the buyer can turn to the Consumer Disputes Committee. The Consumer Disputes Committee is competent to resolve disputes arising from the contract concluded between the buyer and the Online Store. The review of the buyer’s complaint by the committee is free of charge.

The buyer may turn to the European Union consumer dispute resolution platform.
